Legal Question in Criminal Law in California
expired probation search
police were called to the house re: a disturbance. After questioning my boyfriend & I, our names were checked for any warrants. We live in a small city & this was done by going through Sacramento County. My boyfriend's name returned as being on searchable probation. His house was searched, & incriminating evidence was found. 2 months later, came to find out his probation had been expired 10 days before the search took place. our attorney filed a writ, it was denied. he gets sentenced in2 weeks. What can we do?

It looks as if it may have been an illegal search. Regardless, the judge denied the writ. You boyfriend may have the opportunity for an appeal. Contact us so we may discuss the issue in more detail.
