Legal Question in Criminal Law in California
Expunge or Seal
What is the difference between expungement or sealing of a record? I was arrested 14 years ago and after 4 months of court, the charges were dismissed. Now when I apply for a government job, this record keeps popping up. What can I do?

Sealing is a better remedy. There the records are hidden from anyone's view and can't be seen without a court order. But sealing only applies if you were a minor at the time of the arrest (which you don't state here). Expungement causes a dismissal of the case, but adds an entry to your rap sheet for the act of expungement. But your case was dismissed, so expungement won't do you any good. So, the best thing to do would be to sit down with a criminal lawyer and discuss this fully. There are some other sections of the Penal Code that allow you to make your record better than it is. I believe there is a way to have the arrest expunged. If the dismissal was not through the P. C. 1000 program. There is also a way to have your felony downgraded to a misdemeanor. Normally when applying for a non-governmental job, misdemeanors don't count.
