Expunging a Felony Conviction

Can a felony conviction be expunged in less than 10 years after the conviction? Beside no further problems with the law, what are other things that are considered in granting this?

Thank you for your posting.

To be precise, a felony cannot be expunged. That doesn't mean you don't have options, however. You can obtain a certificate of rehabilitation if the felony was in California, but as you suggest, that takes a period of 10 years from the conviction date. If your original case was a "wobbler", meaning that it can be charged as a misdemeanor or felony, you can bring a motion to reduce it to a misdemeanor, and then expunge the misdemeanor, taking it off your record. "Good cause", or a good reason to do so, has to be shown, and the other considerations, as you've asked, are whether or not you've received any new violations, and whether or not you completed all of the terms of probation.

The answer to your question is maybe. Certain felony convictions can never be expunged and therefore, the applicant must apply for a certificate of rehabilitation (Governor's Pardon).
