Expunging a Felony Conviction.

Six years ago someone got a felony conviction which the public defender indicated could later be expunged, reducing it to a misdemeaner. Is there a time limit on this and what is the procedure?

If the guy got probation, the conviction can be expunged pursuant to Penal Code Section 1203.4 after the probation ends. There is no time limit other than that. It can be done immediately after probation ends or at anytime thereafter. Talk to a lawyer in your area about the procedures. P. C. 1203.4 has been replaced by 1203.44 to 1203.49. Go to the clerk in your closest court house and ask for the form to fill out. Read the form and see if you can handle it. If you have a problem you may want an attorney to help you prepare it. So after you get the form(s) make some copies and try filing it out.
