Legal Question in Criminal Law in California
Expunging a Felony Conviction.
Six years ago someone got a felony conviction which the public defender indicated could later be expunged, reducing it to a misdemeaner. Is there a time limit on this and what is the procedure?

If the guy got probation, the conviction can be expunged pursuant to Penal Code Section 1203.4 after the probation ends. There is no time limit other than that. It can be done immediately after probation ends or at anytime thereafter. Talk to a lawyer in your area about the procedures. If the conviction was in LA, you're welcome to call me for a free consultation. My telephone is (310) 393-0639.

There is no time limit on which to expunged!! However as far as the procedure you will most likely need an attorney. You can call me for a free telephone consultation at 818-998-1584
Re: Expunging a Felony Conviction.
P. C. 1203.4 has been replaced by 1203.44 to 1203.49. Go to the clerk in your closest court house and ask for the form to fill out. Read the form and see if you can handle it. If you have a problem you may want an attorney to help you prepare it. So after you get the form(s) make some copies and try filing it out. If you have a problem take up the offers of free consulations from the two attorneys that gave you advise earlier.
