Legal Question in Criminal Law in California

expungments

Hi, I was wondering if They still do expungements and if so does it matter if the person has been on parole or probation or have been in prison before. Thank You

Re: expungments

There are two kinds of "expungements." For misdemeanors, when you successfully complete probation there is Penal Code Section 1203.4 which is a form available at the courthouse which you file with a filing fee of $60. If you did not successfully complete probation, see a lawyer for help. For felonies, there is a "certificate of pardon and rehabilitation" that you can apply for if it has been five years since your parole ended and you have not been in any more trouble since then. You should get legal help for this one. These types of "expungements" are good for not having to tell potential employers about your case(s). They do not work for some purposes such as government jobs or if you later face new criminal charges.

Re: expungments

The process for expungments is easy and can be done on your own. The added facts of parole and prison will make a difference but will depend upon the details. Call if we can help.
