Legal Question in Criminal Law in California

Extradition and probation

i got some dwi charges and the cop said i kicked him and placed 3rd degree assault charges (misdemeanor)

I plead guilty for the dwi because my then attorney told me that i would get two years in the penitentary if i didn't plead guilty.

i didn't plead on the third degree assault.

its been almost two years and I am still going to court.

Because I have no family here, and because I have been getting harrassed by police every since, I moved back to California.

do you think they will extradite me back to missouri? I am on probation and havent gone to trial on the other case. Nothing is a felony..

Re: Extradition and probation

Thank you for your inquiry.

I am not a member of the Missouri bar, so I cannot advise you on Missouri rules, procedures, or law.

Here in California, they can and sometimes do extradite, but typically, it is up to the issuing state (Missouri) to pick you up. If police find you, they can hold you until Missouri does, and if they do not hold you for a reasonable time, they must release you.

I hope that this information helps, but if you have further questions you need answered, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. Im happy to help in any way that I can.
