Legal Question in Criminal Law in California
My Ex-wife claimed to have dropped her restraining order against me, and in fact brought me a forged dismissal document from family court. She subsequently falsely claimed battery and restraing order violation when i refused to remarry her. She continues to contact me illegally and expects to move back into my house with me, and promised to drop the retraining order immediately.
How can I defend myself from these charges and isolate myself from her to prevent more charges the next time she refuses to be rejected?
I did attempt to have her restrained from me previously, and was denied. In addition filing against her harmed my custody case (I had 50% custody for years and was reduced to 9 hours of supervised visitation per month when she had me arrested for pouring a tiny amount of beer on her the first time).

The courts aren't going to look kindly on somebody forging court documents and manipulating the system like she is.
But - the bottom line is you're charged and must defend yourself. Unfortunately, it's not a do-it-yourself project. You need to get the court case squared away and clear your name, then use that to undo the child custody and visitation issues.
I had a case similar to this - a guy's ex filed false sexual abuse charges against him, filed multiple restraining orders - all based on false claims. We were able to get all criminal charges dropped and he ended up with full custody of his kids.
Every case is unique, but do false charges get filed? Unfortunately they do. You've got to protect yourself. It's time for a criminal defense attorney that routinely practices in the court where yours will be heard.
