Legal Question in Criminal Law in California

fabricated police report

i was arrested for possesion and paraphnelia when i read the police report the officer lied and claims there was an altercation between he and I therefore i am also charged with resisting . now several months later charges have been filed but I never said anything , did i make a huge mistake ? Cops seem to bend the truth all the time when they find it is in their best interest . Should we not allow it

Re: fabricated police report

No. It is better to avoid the risk of saying something you will later regret. The testifying police officer's credebility for honesty will be tested by your attorney at a subsequent court hearing. Motions can be filed to discover prior incidents of the arresting police officer's misconduct, such as fabricating arrest reports.

I wouldn't allow it, but then again I'm not your lawyer.

There was no mistake or anything you should or could have done. Stuff happens. You are just among (too many) people who ran up against lying cops, it seems.

Lies from the police can often be fought effectively. Get a good lawyer to keep you out of jail and with as clean a record as possible.
