Legal Question in Criminal Law in California

Failed prop 36 what to expect in court

My son Failed prop 36 and goes to court on the 31st of Jan. The terms of the probation were to enter a drug treatment program and complete it, pay all fines imposed or atleast be paying on them, and had 3 chanses to complete a program. He has not done either and has violated his third chance. He goes back to court on the 31st of this month and he's afraid he will be sent to prison. He has no real excuse of failing other than he had no transportation to get to his meetings and no steady job to pay fines. Will he be sent to prison or will he get a 90 day county time? The amount he was in posession of was less than a gram of meth and the charge was a felony and was not droped to a misdemeanor. What can we most likely expect to happen in court Tuesday? Thank you for your time and input.

This response is late because the question was not received until February 1, 2006. You know what the result of the court hearing is, next time ask your question further in advance of the court date.
