Legal Question in Criminal Law in California

failure to appear on a traffic violation.

How to take care of a warrant without appearing. The warrant is failure to appear on a spended license, without a lawyer present. Can it be done by phone? It has been 8 years old.

You cannot recall a warrant over the phone. You have to have an attorney appear for you or appear yourself. Driving on a suspended license is not a traffic matter, it is a criminal misdemeanor. Please contact me at 310/277-1707.

Thanks for your posting. If you did not appear for a citation, you must appear in person, or have an attorney appear for you. You cannot take care of a warrant by phone. Length of delay in taking care of this shows your responsibility, so you will want to take care of this as soon as possible, and give good reasons to the judge why you did not take care of this sooner. You may have to be prepared to pay the fines in full immediately, as judges may not trust you to make payments or complete community service. Finally, having an attorney handle this for you removes some of the danger of you being arrested without preparation, and shows responsibility in handling this.

I hope this helps -- but if you do have other questions, please feel free to email me anytime, or call my office at (toll free) - 1-877-568-2977. Best of luck, Robrt
