Legal Question in Criminal Law in California

false charge

My wife lied to the police and said I hit her. I pleaded no contest just to get out of jail quickly because I felt unsafe there. I have been sentenced to community service and anger management classes. My wife wants to confess that she lied so I dont have to be punished for a crime I did not commit. Is it to late to have my sentence dropped? Or am I out of luck since I already pleaded no contest and gave up my rights?

Re: false charge

It may be possible to make a motion to withdraw your plea based on learning the new information (that your wife is willing to say she lied). Had you known that prior to pleading to the charge, you would not have entered the plea. This is very complex and not suitable for an email discussion, but if you'd like to talk to me about this, please don't hesitate to contact me. The sooner you make this motion, the better, so don't wait. Good luck. Steve Mandell
