Legal Question in Criminal Law in California
false charges/P.D. harassment
i was arrested 5/31/08 on under the influence of controlled substance charge, i was cited & released. the citation stated i was to report to court 7/21/08, when i went i was told that i did NOT have ANY criminal cases in Orange County & that the citation was never filed. i just found out i have court for a PC 530.5(c) charge with the same violation date & i was never informed of the court date or the fact a new charge was being brought. i kw i have not used anyone else--name removed--identity when being charged for anyother crime. what is going on here? this same P.D. has been staking out my house, slandering my name in public, and have even gone to my family residence & told my family lies that i had arrest warrants, that i was a ''known'' drug dealer and that there is a ''hit'' out to kill me. all lies about me what can i do about this? can i be arrested when i go to court tomorrow?

Re: false charges/P.D. harassment
Explain to the court that you received a citation and showed up to court as required. Also say that you just learned about the warrant and are coming to court as soon as you have learned about it in order to attend to the matter. It would be best if you had a lawyer. If you cannot afford a private lawyer, ask to have a public defender appointed for you. I would contact the public defender's office as soon as possible, actually.
Before you go, find out if the warrant comes with bail attached. I would have a bondsmen ready in case you need to pay it. Chances are if you show up the bail will go down but on a PC 530.5(c) there is bound to be some anyway.
The longer you wait the worse of a problem you will have.
Once the warrant matter is taken care, you will deal with the underlying case - best by hiring a lawyer.
Hope this helps,
