Legal Question in Criminal Law in California

False Police Report

I beleive I may have had my live in girlfrined wrongly arrested on a DV charge. I had some scratcheds and red marks which I beleived she caused. Unfortuantely I now beleive I blacked out due to alcohol and prescription meds just before the incident and caused the injuries myself. What should I do?

Often when females are arrested for DV the district attorney won't prosecute. Do nothing. Give thanks you weren't the one arrested.

Drinking and using prescription medicine at the same time heightens the effect of both drugs, this is dangerous and can kill you.

Blacking out while you are drinking is a sure indicator that You Have A Drinking Problem.

Re: False Police Report

In all likelihood, your girlfriend cannot be convicted without your testifying against her at trial. Your dilemma is be whether you could legally avoid having to testify against her. Based upon the information you provided, it sounds like you might have grounds to assert your 5th Amendment right against incriminating yourself.

You need a confidential consultation with a lawyer to explore all your options. Getting into a more lengthy discussion here would not be appropriate. Feel free to contact me if you wish.
