Legal Question in Criminal Law in California

False Police Report and Mischievous Assault

I had an incident where a car I had followed off the freeway and then passed on city streets, chased me.The male driver and female passenger jumped out of the car. The male yelled at me and hit my windshield with an orange cone and cracked it. He then jumped in his car and took off. I called 911. Filed a police report. About a week later, a detective came to my door threatening to arrest me with a hit and run accident. I told him my story and also about my police report number which was filed about two hours before theirs. He called me back and said that they deny everything and that the female who claimed to be driving the car was filing a personal injury lawsuit. The detective told me to bring my car into the police station which I did and he noticed that there wasn't any damage at all on my car. He would send the investigation to the city attorney's office. I went searching for witnesses and on my 3rd try,I found,a security guard who saw the whole incident with the orange cone and even wrote down the license plate. I gave the witness's name to the detective. What happens now ? This should clear me but I suppose that the man and woman are in a lot of trouble.

Re: False Police Report and Mischievous Assault

The information above is provided as an accomodation only, and should not be construed as either the provision of specific legal advice on which you may totally rely, or as the creation of an attorney- client relationship.

You should report this incident to your insurance company. This report should include all of the information that you provided the police officer. By reporting the incident to your insurance company you are protecting yourself. If the woman in the car does attempt to file a claim for personal injury with your company, your company cannot claim that yo failed to report the incident in a timely manner.

The woman has one year from the date of the incident to file a lawsuit against you.
