Legal Question in Criminal Law in California

I'm on Federal Probation, and I met my boyfriend while living at the halfway house where we were both residents. After we were released we kept seeing eachother, and although it's an unlikely place to find true love, we are both very much in love and want to get married. We are both doing well, with steady employment and living responsible, sober lives. However, my ex (who is also my codefendant) found out I was dating this man and had his mother call my PO and tell her that I was dating a felon. My PO has told me I'm no longer allowed to see him, even though his PO has no problem with it and our PO's even work in the same office. My problem is this, I have not seen him since I was told by my PO not to a week ago, but now I think I'm pregant. What do I do? Can they really keep us apart if we're having a baby?

The bottom line is you do whatever your probation officer says ...if you are, in fact, pregnant, you are far more valuable to your baby out of prison than in prison. You are on federal probation which means you have absolutely no leverage. The better relationship you keep with your probation officer, the more likely they will give you some leniency.

That being said, since your probation officer already knows of your relationship with this person, you can still explain your current situation to your probation officer but make sure you clearly tell her that you have ceased to have contact with this person since she told you not to and that you will continue to do whatever she advises.

Also, if you had an attorney represent you in your federal case, you may want to give a call to see if there is anything the court can do to modify the order ...but be careful, you don't know how the court is going to react to the fact that you have been associating with known felons.

Good luck to you and think of your baby before making any decisions.
