Felonies

How long does a person have to report a felony on an application for work. This felony was paid off right away, and has been over 5-7 yrs. ago. MY daughter is having a terrible time finding work.

It sounds like your daughter needs to apply to have her conviction sealed. (expunged) If this is her only conviction she should be able to do this and then she will be able to honestly say that she does not have a conviction. The process will take 90 days to 6 months. The cost will depend on the attorney and whether or not the Court will require a hearing.

If this was her only offense, we can have it expunged for her, that is, completely erased from her record and she would not have to declare it anymore. Contact me directly if you like.

There is no period of time after which she need not report the conviction. However, as the other lawyer indicated, she may be able to get the conviction expunged. But before I could advise you on whether or not she is eligible, I would need to know, first, what the conviction was for, and second, what other criminal convictions does she have, including misdemeanors, either before or after this conviction?

As indicated by the other 2 answers, the felony conviction remains on her record forever, or until she takes the steps to "expunge" it from her record. If it's a California conviction, it can be expunged unless she went to state prison for her sentence. This doesn't include a shorter period in county jail as a condition of probation, however. Assuming, without knowing the prior felony is a Californai case, Certian otions are available depending upon the total record, the actual felony for which the Daughter was convicted. Without knowing the precise facts, further clarity cannot be provide, but California has multiple was to expunge the record...it all depends on the record.

I presume this has to do with a felony from Ohio, if that is the case, then you would have to look into expunging the underlying case in Ohio.
