Legal Question in Criminal Law in California

felony charge

ok i asked a question about, my freind who has power of attorney over me. the courts told me that i could have a relative, or a spouse go in and file the paper work to get me on calendar so i can fight my case, or atleast give me time to get an attorney, however they said unless i have someone who i can trust to sign over power of attorney too and they could go in on my behalf and file the paper work for me. well my best friend has power of attorney over me and i need to know if he can go in and file my paper work?

Re: felony charge

The act of "filing" your paperwork can be done by anyone you choose, and does not require a power of attorney. *Signing* the paperwork, however, is another matter. Only you or a licensed attorney who represents you can do that. A power of attorney is not a license to practice law, and the friend who holds it cannot act as your representative either in court or in any papers filed with the court.

Re: felony charge

If you are talking about a criminal case in which you are facing charges, I do not believe there is any way to do it other than to hire a lawyer.
