Legal Question in Criminal Law in California

Felony criminal charges

I was exiting a county jail when i was surrounded by law enforcement who asked to search my car. Not having anything to hide i agreed. It was then they discovered i had unopened alcohol beverages and a trace of marijuana in my car. My car was used the night before by a family member but i had no knowledge of anything being in my posession. They are charging me with 3 felonies..What are the chances of my charges being dropped since i have never been arrested in my life?

Your chances might be pretty good especially if the family member or members are willing to step forth and say the alcohol and the marijuana were theirs. You should have your case evaluated by a lawyer most of whom will do it in a free and confidential consultation.

Please feel free to contact my office if you desire additional consultation.

You need a lawyer on the case ASAP! An experienced criminal defense attorney will start building your defense immediately so that s/he can present a strong case to the DA and/or to the jury, if need be.

A decent attorney would get to the bottom of this case - including figuring out what prompted the cops to focus on you and your car? In addition to the family supporting your claim, your attorney would want to establish - through independent means - that you were in no way connected to the items in any way possible. (E.g., fingerprints on bottle not yours, no evidence of your consumption of either substance, other corroborating evidence to support car occupied by others including proof car at location where you weren't and/or you at location where car wasn't, etc.)

All of this would start with the attorney sitting down and doing a thorough interview with you to develop leads on where helpful evidence of your innocence could be found.

Consult with at least three lawyers and ask each how they would approach the investigation of this case. Their answers will help you decide which is one is the best lawyer for you.

I'm available for free consultation if you want to discuss this further.

Re: Felony criminal charges

If you're being charged with three felonies, the fact that this is your first arrest won't be nearly enough to persuade the D.A. to drop the charges. You will have to fight the case on the merits, and to do that right you will need a good lawyer.

I agree with Mr. Lentz and Ms. O'Connor that getting the real perpetrator to step forward would go a long way toward helping you. At the same time, it would most likely get the perp charged, prosecuted and (if convicted) imprisoned instead of you. He or she isn't likely to jump at the opportunity to do this for you. Even if I'm wrong about that, you may want to make sure your relative has separate counsel before confessing. Your chances of getting the charges dropped will decrease if your relative has a lawyer, so you are in the unenviable position of choosing between your own interest and your family member's in staying out of jail.
