Legal Question in Criminal Law in California
felony Department of Justice Record
I was arrested on a felony charge of domestic violence. My charge was reduced to a misdemeanor offense of public disobedience. The Department of Justice still has it listed as domestic violence and my court record was purged years ago. How can I clear my record?

Re: felony Department of Justice Record
You need to get a Certified Court Docket or Minute Order from the court where you were convicted showing the final disposition of your case, i.e., exactly what you were convicted of after the reduction to misdemeanor. Then you use this document to request a correction of your records with the Department of Justice.

Re: felony Department of Justice Record
The Department of Justice Record will show what the arrest was for, what the charges that were filed were and what the conviction and subsequent sentence imposed. It will also show a dismissal following a 1203.4 petition, commonly referred to as an expungement. If you are saying that the Dept. of Justice record is showing that your conviction was a felony domestic violence then go the DOJ website and they will give have the procedures and forms to contest the record. If you are saying that it is showing the original felony charge along with the reduced charge that you plead to, then that is how it will always read.
The website for the California Department of Justice regarding criminal history reports and how to challenge the information in the reports is http://ag.ca.gov/fingerprints/security.php
