Legal Question in Criminal Law in California

felony drug charges

the house I live in was raided and they found a digital scale which is illegal and marijuana plants. The cops arrested my brother and I since we lived there. I have nothing to do with this at all but my brother wont admit to the truth we are being tried together and I dont want to take the plea and end up with felony probabtion as I am not guilty. they say its either him or me or both of us I have a bright future and this could ruin it what can I do because my public defender is not helping much. What do I have to do to prove I am innocent

It's pretty hard to tell you what to do to beat the charges, but your strongest constitutional right is the right to have a trial and let a jury hear the evidence against you and decide if you are guilty or not. There are many variables to deal with and dynamics that occur when you do that, and it can only be analyzed with a knowledge of all the "facts" of the case (meaning: one, the allegations in the police report and two, the truth). You have the right to have your case heard by a jury of your peers and be represented by a competent attorney of your choice. If you are not satisfied with your public defender consider hiring a private lawyer.
