Legal Question in Criminal Law in California

Felony Expungement

My friend received a felony conviction 7 years ago. Since then he has had it reduced to a misdemeanor charge anddismissed. He still has to claim he is convicted of a felony on applications for the state and federal government. He would like to apply for employment as a police officer, but needs his felony expunged. What are the steps to getting an expungement? Since his felony he has completed school, joined the military and led a normal life.He would like to have this expunged so that he can continue on in life without this one mistake holding him back.

Re: Felony Expungement

An expungement is probably not going to help your friend very much even if he could get one. The felony conviction seven years ago will likely come up in his DOJ background check and he will not be able too become a police officer. If the charge was reduced to a misdemeanor he can most likely have it expunged, but it will likely not make a difference in this instance. The process is fairly simple. You just need to pick up the form (1203.4 PC) and submit it to the court. Again, I must reiterate that it will most likely not help him get into any police department. Standards are fairly high and even misdemeanor conviction will likely get you bounced from consideration.
