Legal Question in Criminal Law in California

Felony Hit & Run

My brother is serving 3 months in a detention center for a felony hit & run. My question is when he gets out on July 28th will he most likely have probation and does the DMV usually take away your license for a period of time. My Mom is the insured and is letting a attorney handle this, but communication isn't the greatest. Also could the insurance company drop him from the policy? Because he pleaded guilty to the Felony Hit & Run, the insurance company will then pick up the tab for the attorney.

Re: Felony Hit & Run

I don't know the specifics of your brother's case, but generally if someone is setenced to up to or less than one year in the county jail it is because they were placed on probation rather than being sent to prison. Jail is usually a condition of probation. Depending on the violation that he was convicted of, DMV could revoke his license. Normally DMV sends notice of their intent to revoke a driver's license. I can't answer as to what the insurance company may or may not do.

Good luck to your brother.
