Legal Question in Criminal Law in California
I am a female college student aged 19. Recently, a 45 year old gentlemen aged pressed charges on me for assault.
We got into an altercation. He cursed at me and flipped me off repeatedly touching my face.. I then pushed him off to get away from me.. I was intimidated at an older man before so close to me and wasn't sure what he would do. It's shocking someone my dads age would actually approach me in such a manner. After this I immediately left the scene.
This man is my brothers girlfriend dad. They are only 16 and have a child together. Thus there is alot of family drama. Before filing charges, they kept saying, "we don't want to file charges but if you dont do blah blah blah.. we will file charges against you." in a threatening manner.
I then got a call from a police officer and apparently they are now saying I charged him and hit him with my fist 5 or 6 times across the back of his head. The whole family is willing to "testify" to this.
My whole family and myself were shocked at this considering I only pushed him to get him off me. Several members of my family were also there and testified my story is what happened.
He did not call the police immediately but filed the police report the next day. He obviously had no injuries and proceeded to stay at the scene for several hours. I have no violent history and live an hour away. Also, at the time this was in a church and I was wearing high heels and a tight pencil skirt that I have trouble even walking in.. I know this doesn't have anything to do with the law but if I would have ran or charged it would surely have ripped.
I told the police my side of the story and they said it would be sent to the DA.
I'm really worried because they keep telling me I'm going to jail. I am studying to be a scientist and really worried this will affect my financial aid and school. I just never thought I would go to jail for pushing someone who could clearly pose a harm to me and is the one who initiated the confrontation.
The police said the DA probably won't prosecute it but I'm worried that their lies will send me to jail.

it sounds weak but there is nothing you can do. If they prosecute you then hopefully you have a good attorney and good witnesses.
