My fiance commuted Grand Theft retail I was asleep in the car will a conspiracy to commit retail theft hold up in court Los Angeles CA

Whether you're guilty of conspiracy will depend on what happened before the theft. That you were asleep during the theft is not enough to defeat the charge. That doesn't mean you should lose; it just means that, if you win, it won't be for this reason.
