Legal Question in Criminal Law in California

filing a 1381 form

I have criminal charges pending in a couple different counties in California. Some being, F.T.A. on those charges. What I would like to know is, Can I file a (1381) ''Demand for Trial'' while not in custody? And if not, What are my alternatives? The different charges are, Driving on a suspended license, Various traffic violations, and the F.T.A.'s.

One alternative is to do nothing as you have been and wait. Sooner or later you will be stopped by a traffic officer and the warrants will be seen and you will be arrested. Depending upon the warrant requirement you may be cited and released or you could be held in custody until the county in which the warrant was issued picks you up.

The other alternative is to go to each of the the courts and arrange for a court date and then appear and pay the fine or due the jail time. This way you would have some control over the timing for each case and can avoid being arrested at a very embarrassing and inconveinent time. Retaining a attorney the practices in that area to appear for you.
