Legal Question in Criminal Law in California

Did not follow through on drunk driving payments/alcohol school

I was convicted of drunk driving 7 years ago. (This was a 2nd offense in just under 7 years - no brush with the law at all since). I want to put this in the past and was wondering the best way to go about this. Can I forego the alcohol schooling and simply pay the fine due to my 7 years of complete adherence to the law (sort of - as I had not met by court prescribed obligations)? Will the judge accept the fact that I am no longer a threat due to my abstinance of drinking alcohol for the last 5 years. In none of the 2 drunk driving convictions did I injure others or myself or cause any accidents. Please let me know my options.

Drinking Driver School

Unfortunately, there is absolutely no flex in the requirements for the drinking driver programs. The school you must attend is SB38 and until you complete it, you will not be licensed in any state which is a signatory to the compact on DUI'sI can only suggest that you get going and start in on the program. After a moderate amount of progress, you will qualify for a restricted license. The other problem which you have is the possible (probable) probation violation. For that, seek counsel immediately in the geographical area of the Court where you were convicted.Do both of these things now. It will help on the p/v that you have enrolled in SB38.Good Luck
