Legal Question in Criminal Law in California

Forgery - signing spouse's name to a Federal tax return check?

Is it considered forgery to sign your spouse's signature to a Federal tax return check, even if the return is for a joint return. (each spouse equal to half of the return)?

Assume signing the signature without the other spouse's consent.

Is that forgery?

Signing another person's name on a document and producing it as their true signature is forgery. The penalty for forging a signature on tax documents can be severe. It is likely that your wife will find out about this eventually. If she files a complaint you could be in serious trouble.
