Found laptop in empty classroom, is it theft.

I am not sure what the specific charge would be against the individual taking the lap top, but it is illegal. Just because something is not in the physical custody of the owner does not mean it is up for grabs.

It is theft of lost property. Penal Code section 485.
"Finders keepers" is NOT the law. Turn it in to law enforcement, the library staff or take steps to return it to the rightful owner immediately.
