Legal Question in Criminal Law in California

fourth waiver search and sezuire

2 empty baggies containing a ''usable amount'' of an unknown (to us) controlled substance were found in the battery compartment of a clock in a hotel room that was rented by my boyfriend during a random, unwarrented, fourth waiver search. The phase one public defender (the public defender who pleads you out, not the one who represents you)said it wouldn't be possible to have fingerprinting done on the baggies due to ''texture of baggies'' when we requested it be done because clearly they were put there by previous guests and how else could it be determined they did not belong to either of us? is it true about the fingerprinting? help!?
