Legal Question in Criminal Law in California
I think my friend is in some deep @!%$ but you tell me. what do you think the typical sentence would be for?
my friend got arrested 2 days, they were at a park and he was with a bunch of minors and some were on shrooms at the time and some were just there to hang out but it was very obvious he was selling them. he had a little less than an ounce of psilocybin mushrooms that i know of. here are his charges:
Felony 11380 (A)HS, basically selling narcotics or what not to minors.
Felony 11379 HS, possession of a controlled substance with intent to sell.
Felony 11378 (A)HS, possession of a controlled substance.
Misdemeanor 272 PC, contributing to the delinquency of a minor.
About a year ago he was caught for selling marijuana which later got reduced to a simple possession charge. a little longer than that he was charged with a DUI basically and somehow got a slap on the wrist for that to.
i would like to know what you think he will be sentenced with, and does he have a chance at all to go out on probation????

You're asking for a guess as to the outcome and what his "chances" are in this case.
Here's the bottom line: He's in deep. The 11380 is a strike in California's Three Strikes law and the charges themselves are serious. He's potentially facing a long stint in county jail if not state prison. He needs a very, very good criminal defense attorney to represent him.
