Legal Question in Criminal Law in California

My friend was rape and she report it to the police and he was release and DA is not press charge. My friend US Visa expired so she a non-citizen do this play a part in why the rapist will not be charge

Maybe, but it's unlikely. Prosecutors usually pursue rape cases when there is a reasonable chance of getting a conviction. The victim's citizenship status has virtually nothing to do with whether the case is winnable. There are a variety of other reasons that are more likely to explain the D.A.'s decision.
