Legal Question in Criminal Law in California
Friend won'r return borrowed truck.
My friend took over payment for a truck still under my name. Now late 3 months with payments and I want it back since he won't pay. The truck is still in my name, but my friend is refusing to give the truck back or pay for it. Can I take legal action against him and/or file a stolen vehicle report with the sherriff department?

Re: Friend won'r return borrowed truck.
You shouldn't file a stolen vehicle report since your friend had your permission when he obtained the truck from you. Breaking his deal afterwards does not retroactively make him a thief.
You can sue him for what he owes and/or for possession of the truck, though you can only receive one or the other. Keep in mind that you are still obligated to make the payments if he doesn't, unless the lender has agreed to let you off the hook.
