Legal Question in Criminal Law in California

My girlfriend and I are accused of grand theft. Let's say, my girlfriend offers to testify against me in exchange for exhoneration of the charges against her.

Let's say, The D.A. agrees and the papers are drawn up and signed by both parties.

Now, If I were to pass away (die) prior to trial, Would the D.A. still have to abide by the agreement and exhonerate her charges?

What if I were to fail to appear?
