Legal Question in Criminal Law in California

my ex girlfriend is filing for a restraining order on me because she says that I do not leave her alone. I wait for her after work and I follow her at lunch and I have even called her a few times because I want to get back together with her. Since I got served with papers to appear in court I have stayed away from her and I am planning on moving back to Mexico. Can I do that and not appear???please help me. I have never been in trouble with the law

First, it's not good to have a restraining order on your record...especially a "Clets" restraining order, which a domestic violence restraining order is. So, in my opinion, it would be better to negotiate, (NOT YOU..But an attorney on your behalf) a stipulation, that if you move to Mexico very soon, her restraining order will be vacated. STOP FOLLOWING HER.

She has a right not to be followed.

You have no right to do anything but leave her alone.

Your attorney may convince the judge to forgo the restraining order on condition you leave the state and don't come back. Get an attorney, do NOT handle it yourself, and get counseling for your loss (we have ALL BEEN THERE, even the judge), and remember:
