If givien probation ill do a yr county time?

I am charged with receiving stolen property. I was charged with the same charge 4 years ago and did 2 years in prison. now the courts are offering me 16mos . although they are giving me opportunity to do a yr probation (local time) if probation accepts me. I don't understand this I thought probation meant staying out of custody .

It sounds like they are giving you less time than they would have given you if you didn't accept probation, but it doesn't really make sense to me, either. I mean, you would be on parole after prison anyway. Do you have a public defender? I think you could get a better deal than this, actually.

Is this a second charge or is it based on the same receipt of property? It sounds like they are giving you the option of one or the other, or perhaps it is jail time followed by Probation.
