Legal Question in Criminal Law in California
A grand jury indictment how many jurors are suppose too be. There too delibrate and deliver a verdict?
1 Answer from Attorneys
Grand juries don't deliver verdicts. They hand up indictments. After being indicted, a criminal defendant is entitled to a jury trial before a "petit" or trial jury of 12 people of whom all 12 must vote "guilty" for there to be a guilty verdict. In Los Angeles County, California, the criminal grand jury consists of 23 jurors of whom 14 must vote for a "true bill of indictment" for the defendant to be indicted. While, theoretically, a grand jury could vote "no true bill" and the defendant would be acquitted, this almost never happens. One reason for this is because, unlike criminal jury trials, grand jury proceedings are held in secret and there are no lawyers allowed except for the district attorney.
