grand theft property

I've been charged with grand theft property, stealing clothes from Macy's. I have a 3 yr joint suspention for petty theft and on probation. Does 16 months state sound right or can I get less time?

The minimum sentence for grand theft under Penal Code 489 is 16 months in state prison. Other available sentences for grand theft are 24 and 36 months. You would have a much easier time of convincing the prosecutor to drop the charges down to a misdemeanor if you were not previously on probation.
