Thanks for your posting.

Disturbing the Peace, which is Penal Code section 415, states that an offender that pleads or is found guilty, "shall be punished by imprisonment in the county jail for a period of not more than 90 days, a fine of not more than four hundred dollars ($400), or both such imprisonment and fine."

Penal Code section 272 is more difficult to give you a straight answer on, as it may be charged as either a misdemeanor or an infraction (fine only). If a misdemeanor, it could carry up to one year in jail, and a $1,000 fine.

Each law has a minimum and a maximum, and the sentence you will receive depends on the exact charges, what court you are in, the personalities of the D.A. and/or the Judge, to a certain extent, and the particular facts of your alleged crime. An attorney can help you make sure your case is reviewed for any legal motions, all factual defenses, and negotiated so that the charges, if not reduced or dismissed, are closer to the minimum than the maximum.

I hope this helps, but if you have other questions, or want help, please feel free to email me directly at [email protected]. Best of luck.
