Legal Question in Criminal Law in California
What happens if...
I heard a rumor of a law that states, if one is involved in a sexual act with a minor, one will go to jail for 40 days, no questions asked. The age difference is 3 1/2 yrs. It was my understanding that if the parents pressed charges then the latter would apply, but if the parents are not concerned then what happens? Thanks.

Having sex with a minor is an offense that can bring a prison sentence. It is statutory rape regardless if the person consents. If it is reported to the police you will be arrested.
