Legal Question in Criminal Law in California

Hi,

My husband and I retained an attorney and signed a "fee contract" for $4000 in Sept. 2008. The contract says "Client will deposit $4k with attorney. This will be used to cover all legal fees and remaining balance will be refunded within 30 days after representation has ended." We were billed for $1100 of work and expected the balance of $2900 to be returned. The attorney sent us a check for $1000 and said the $1900 balance was the "retainer fee". No where in the contract does it state he would charge a retainer fee or keep any monies other than for what services he performed. Is this legal or should we dispute this charge and go to arbitration? Thank you
