Legal Question in Criminal Law in California

Hit & run

My car was used in a minor hit & run without my knowledge/consent.

Police are asking me to find out who was driving. Do I need to comply? Will I incriminate myself or a family member (whoever was driving)?

Re: Hit & run

Technically speaking, you do not have a duty to tell the police anything as long as you do not lie to them. Lying to the police could result in separate charges against you.

If you do not tell the police anything, there is a possibility you will become a main suspect since the car was yours. That might not be the case if there is a description of a person who drove the car and it does not match you or if you have an undisputable alibi.

Another possibility is that if there is prosecution against someone from your family, you will be forced to testify on the stand during trial.

I would consult at attorney to go over your situation in great detail. I would not talk to the police until I have consulted with a lawyer.

Very best,
