Legal Question in Criminal Law in California
I went out to Hollywood with three other girls last night. I was drinking heavily and blacked out. During the period of my lost memories, apparently one of the girls gave me her purse to hold on to it. THEY HANDED IT TO ME. We all were very drunk. Then this morning, I found out that I lost my blackberry and wallet with credit cards in it, and found an iphone, keys, and a credit card in my clutch. When the girls came over to pick them up, they told me I had their purse, so they came up to my room and searched the entire apartment which I didn't get offended by that point. Eventually, we found one of the girls' ids on the floor and her purse in my laundry bag. Everything was in her purse but the other girl's iphone and $200 cash were missing. The girls were asking questions to my roommate who also drank heavily (didn't go to the club with us though) last night, and my roommate mentioned something about me dropping $20 some cash in front of the door when I walked in this morning, and that made this whole thing a bigger problem. I don't have any cash on me, and if I dropped them and didn't know, I probably lost it already. They are dealing with $200 not $20. Then later my roommate changed her words to "not sure."
They were accusing me of stealing and filed a report to our school's DPS, and two officers came to my room telling me that it's my fault for losing their stuff. It will go on my record and if they keep accusing me like this without having one single proof, I could get suspended from school. However, the point is that I just met those two girls last night, and I'm friends with only one girl out of those three. Is it really my fault for losing her items? She could have lost her phone at the club because I lost all my stuff as well. Please let me know.
2 Answer from Attorneys
Its going to come down to credibility, and the ability to recall due to alcohol intoxication. I would be careful speaking to anyone about these facts. It doesn't sound like you are being investigated for a criminal charge but I'm not sure. Therefore, speak with an attorney before you say anything to anyone ............... I wish you well.
