Home Burglary

I was just the victim of a burglary at my home last week. The person broke into my safe and stole all my money *(cash),

the only thing is we know the person who stole the money. he is my brother in law. he has a long history of mostly misdemeanor drug offences and

possesion of paraphanelia. what type of punishment is he looking at if he spends all of the 30K, and the money is all gone. he broke in through a window. any help is appreciated thanks donny

His punishment will depend far more on the amount he took than on the amount he spent. He is looking at a lengthy prison term and an order to make restitution whether he spends the money or not.

Exactly what your brother-in-law's sentence will be will depend upon additional facts. In particular, the nature and extent of his criminal record may result in additional time behind bars. He may get even more time if he is presently on parole or probation. There are other factors which will potentially affect his sentence as well.

The police may have some questions of you as to why you had $30,000 in cash in the safe. With amount of money the question of drug sales is almost a guarantee.

Burglarizing a house and stealing $30,000 is of course a felony and he might well get state prison time. You didn't say how he cracked the safe -- if he had the combination as opposed to using a blowtorch or the Jaws of Life, it might be tough to prove. But that's for the police to figure out.
