Home Depot Business Charge Card
I had found My ex-fiances business charge card for Home Depot a few weeks ago and I had gone down to try to charge gift cards to it and i did not feel right about it and knew it was wrong so I told the clerk at register to never mind and that i did not have id on me. I left the store with nothing. A couple hours later the Corona Police department tried to contact me in regards to a theft. Can I still be charged with theft even if i didnt leave the store with anything? Does the store or the owner of card have to press charges? The officer would like to talk with me but i am so scared that they will arrest me and i have twins that are 3 1/2 to take care of.
Could this just be a scare tactic? The owner of the card has been notified and i dont know if i should call them and apologize for even considering doing something like this as they know that is not me. I am a good person struggling to take care of 4 kids on my own. Please advise. Thank you.

You could be charged with attempted theft or perhaps even commercial burglary. Do not talk to the cops under any circumstances. They will try to trick you into saying something which will incriminate you. People often think they can help themselves by talking but in reality they very rarely do.
I would hire an attorney just for the purpose of talking to the cops at this stage to nip this thing in the bud before any charges are filed. This should not cost you much.
