at what hours of the day can a sopena be served in California? i have heard you cannot be served after 5pm or before 5 am is that correct?

There are no limits on the time of day a subpoena can be served.
You may be confusing the issue with search warrants, which cannot be executed at night unless the judge who issues the warrant specifically authorizes nighttime service.
