Legal Question in Criminal Law in California
My husband got arrested on domestic violence charges and was not sent to court,he was released paper work wise but was rearrested before he was released from jail,is this legal??

It happens all the time. The law states that a person arrested must be seen by a judge within 72 court-hours or be released. When the DA doesn't have the paperwork ready within the 72 hours, they sometimes just re-arrest the person so the 9lock starts ticking again.
