Legal Question in Criminal Law in California

My husband is awaiting to get sentenced in the state of California. The victims family wrote letter to the judge talking negatively. I know we need to write some too, but I don't know what they should be about. How do I approach the judge? How do I conclude the letter? Should it be long and detailed, or short and to the point?

Every convict has a relative who will write, so don't expect your letter to have much weight. Short and to the point.

You may want to talk to your husband's attorney. That person should know what the issues in the case are and can best suggest what to include in your letters. For example, if your husband doesn't have a criminal history and the incident was situational you would want to talk about all the positive characteristics, future plans, etc to show that the particular situation is unlikely to occur again. Judges like to know when a person isn't a safety risk if the defendant is going to go back into the community. They like to know if the person is remorseful and capable of rehabilitation. Talk to your husband's lawyer. I'm sure she or he will have some suggestions and direction for you.

Good luck,
