my husband needs help
I think that i was not clear in the question that i asked he was charged of carjacking and then 2 months later a murder but the problem is they are trying to say the weapon that they found could possiable be the same weapon as in the murder so when my husband looked at his murder case he saw that when they tested the gun it was not 100 percent that that was the gun but in the mean time he has a private attorney for the carjacking but they are putting the case off to see if they are going to convict him of the murder so can they do that? and can they use a gun found a monthand a half after the carjacking by the owner of the car as the possiable murder weapon? keep in mind that these 2 cases are not related but they seem like they will be help

How the gun was found is unimportant, as long as it was found legally. If the prosecutor can tie it to the murder, it won't matter that police found it while investigating another crime.
