Legal Question in Criminal Law in California
my husband was convicted of rape, 4 years after sentencing, we have found out that the rape kit was distroyed without my husband's knowledge. can they do this in good faith, however they kept things like clothing, watch,an icepick. is there any law to protest the convict, he never did post conviction dna testing.

The big question that I have is why wasn't it tested prior to his conviction? DNA testing has been around for some time now, at least a lot longer than 4 years.
